Civil Partnership Dissolution in England What Happens to Property, Pensions and Finances

Ending a civil partnership involves more than the legal process of dissolution. Partners may also need to decide what happens to their home, pensions, savings and ongoing financial commitments. These financial arrangements are separate from the order that ends the civil partnership.

What happens to property and savings?

You and your civil partner should identify the assets and liabilities you each hold, including the family home, other property, mortgages, bank accounts, investments and debts. If you agree how to divide them, you can ask the court to approve the arrangement. If you cannot agree, either partner may need to apply for a financial order so the court can decide. Ownership alone does not necessarily determine the final outcome.

Can pensions be included in a dissolution settlement?

Yes. Pensions can form an important part of the overall finances, particularly where partners have different retirement provision. Depending on the circumstances, a settlement may involve pension sharing or a different arrangement that takes pension values into account. Obtain accurate information before agreeing to give up a claim or finalising the dissolution.

Does the final order settle financial claims?

No. The final order ends the civil partnership, but it does not automatically divide assets or dismiss outstanding financial claims. An agreed financial settlement generally needs a court-approved consent order to become legally binding. It is usually sensible to deal with financial arrangements before applying for the final order because delaying can have consequences, particularly for pensions.

What if you cannot reach an agreement?

Negotiation and mediation may help partners resolve disagreements without a contested final hearing. Where those options do not work, a financial order application allows the court to consider the available resources, each person’s needs and any relevant responsibilities. Both partners should expect to provide clear information about their financial position.
