Asset Division

Dividing assets during a divorce can be one of the most complex parts of the process, requiring careful consideration to ensure a fair and equitable outcome for both parties.

At southgate solicitors, we specialise in navigating the intricate process of asset division, helping our clients reach agreements that respect their financial security and future wellbeing. Whether through negotiation, mediation, or court proceedings, our goal is to ensure that the division of assets is handled with fairness, precision, and with careful consideration as to the needs of any children involved.

The division of marital assets is influenced by a multitude of factors, as outlined in the Matrimonial Causes Act 1973. These factors include each party’s earning capacity post-divorce, the standard of living enjoyed during the marriage, the length of the marriage, and the housing needs of the family. Our approach takes into consideration not just the tangible assets like property, savings, and pensions, but also the intangible elements that contribute to a person’s wellbeing post-divorce.

FAQs

Assets are divided based on several criteria, aiming for a fair distribution that considers the future needs and contributions of both parties. This includes evaluating earning capacities, the standard of living during the marriage, and the needs of any children of the family.

The family home is often the most significant asset, and its treatment varies. Options include one spouse buying out the other, selling the home and sharing the proceeds, or sometimes implementing a Mesher Order, which postpones the sale until a future event, like children reaching adulthood.

While not mandatory, mediation is highly recommended as it offers a less adversarial route to agreement. If mediation fails, the next step is typically negotiations via solicitors and if unsuccessful, applying for a financial remedy order through the courts may be necessary.

A financial remedy order is a legally binding court order that outlines how assets and finances will be divided between divorcing parties.
