Mediation is open to parents or guardians who are involved in disputes concerning arrangements for their children after separation or divorce. Both parents must voluntarily agree to participate in the process. 

Children mediation focuses on matters concerning the children, such as child custody, visitation schedules, schooling, healthcare, and extracurricular activities. The goal is to develop parenting arrangements that promote the children’s well-being and maintain their relationships with both parents. 

During mediation sessions, a neutral mediator facilitates discussions between the parents, helping them communicate effectively, identify common ground, and reach agreements regarding parenting arrangements. The mediator remains impartial and does not provide legal advice. 

Yes, discussions during children mediation sessions are confidential. This means that what is discussed during mediation cannot be used against either parent in court proceedings, unless there are concerns about child protection or criminal activity

Any agreements reached through children mediation can be documented in a Parenting Plan. This document outlines the agreed-upon parenting arrangements however, is not legally binding. If you wish to create a document that is legally binding, a solicitor can have your agreement drawn up into a consent order which can be submitted to the court for approval if necessary. 

The duration of mediation depends on the complexity of the issues involved and the willingness of the parents to cooperate. Typically, mediation can be completed within a few sessions, but this can vary from case to case. 

Yes, while mediators can provide general information about legal principles and procedures, they do not offer legal advice. It’s advisable for each parent to seek independent legal advice to ensure they understand their rights and obligations before reaching any agreements. 

If mediation is unsuccessful in resolving all issues, parents can still pursue other avenues, such as court proceedings, to address their disputes. However, mediation often remains an effective first step in attempting to reach an amicable resolution.
