Mediation is a voluntary process facilitated by a neutral mediator to help couples resolve disputes related to their separation or divorce in an amicable manner. 

Mediation offers couples a structured and neutral environment to discuss their concerns, explore options, and reach agreements on key issues such as child arrangements, finances, and property division. It can be more cost-effective, quicker, and less adversarial than going to court. 

During mediation sessions, a trained mediator facilitates discussions between the separating couple, helping them communicate effectively, identify common ground, and explore solutions to their issues. The mediator remains neutral and does not provide legal advice. 

Mediation itself does not result in legally binding agreements. However, if couples reach agreements through mediation, the mediator will prepare what’s called a Memorandum of Understanding which you can then take to a solicitor to have drawn up into a legally binding consent order which can be submitted to the court for approval. 

Mediation can address a wide range of issues related to separation or divorce, including child arrangements (living arrangements, visitation), financial matters (spousal maintenance, division of assets), and property-related issues. 

While mediators can provide general information about the legal aspects of separation or divorce, they do not provide legal advice. It’s recommended that each party seeks independent legal advice to understand their rights and obligations before finalizing any agreements reached in mediation. 

The duration of mediation depends on the complexity of the issues involved and the willingness of the parties to cooperate and reach agreements. Typically, mediation can be completed within a few sessions, but this can vary from case to case. 

Yes, mediation discussions are confidential. This means that what is discussed during mediation cannot be used against either party in court proceedings. However, there are exceptions to confidentiality, such as cases involving child protection or criminal activity. 

Yes, one of the key benefits of mediation is that it helps improve communication between separating couples. By providing a neutral space for dialogue and facilitating constructive discussions, mediation can help couples find common ground and work through issues more effectively.
