  • Purpose: The purpose of a Specific Issues Order is to provide a resolution to a specific dispute or issue concerning a child’s welfare or upbringing that the parents or guardians cannot agree on themselves. 
  • Scope: SIOs can cover a wide range of issues, including decisions about a child’s education, medical treatment, religious upbringing, holiday arrangements, or changes to the child’s name. 
  • Application Process: Applications for a Specific Issues Order are made to the family court, usually by one or both parents or guardians. The court considers the child’s welfare as the paramount consideration when deciding whether to grant the order. 
  • Best Interests of the Child: The court’s primary consideration when making an SIO is the welfare and best interests of the child. The court evaluates various factors, including the child’s wishes and feelings (depending on their age and understanding), their physical, emotional, and educational needs, and any risk of harm. 
  • Duration: SIOs can be temporary or permanent, depending on the circumstances of the case. Temporary orders may be granted initially to address immediate concerns, with a further hearing scheduled to determine whether the order should be extended or made permanent. 
  • Modification or Variation: SIOs can be modified or varied if circumstances change significantly, such as a parent’s behavior or the child’s welfare needs. Applications to vary SIOs require approval from the court.
