Hybrid Mediation

Not every family dispute is suitable for traditional mediation. Some cases involve complex finances, high conflict, difficult communication, or a need for legal advice during the process.

Hybrid mediation is designed to offer a more flexible and supported way of resolving family disputes without immediately going through the court system.

At Southgate Solicitors, we understand that separation and divorce can involve difficult decisions about finances, property, children and future arrangements. Our team can advise you on whether hybrid mediation may be suitable for your situation and support you throughout the process.

What is hybrid mediation?

Hybrid mediation combines elements of traditional family mediation with features often used in civil mediation.

In traditional family mediation, the separating couple usually meet with a mediator, either together or on a shuttle basis, while their solicitors advise them outside the mediation sessions.

In hybrid mediation, the process can be more flexible. The parties may attend with their solicitors, the mediator may meet each person separately, and discussions can be structured in a way that helps manage conflict or complexity.

The mediator remains neutral and helps both people explore options for reaching an agreement. The role of the solicitors, where involved, is to provide independent legal advice and help their clients understand the legal implications of any proposals.

How is hybrid mediation different?

Hybrid mediation is different from traditional mediation because it can involve:
Solicitors attending mediation sessions
Separate meetings with each person
The mediator moving between rooms where appropriate
More structured negotiations
Private discussions with the mediator
A greater focus on resolving complex or high conflict issues
Support for cases where direct communication is difficult

One of the key features of hybrid mediation is that the mediator may be able to hold confidences. This means one person can discuss certain matters privately with the mediator, and those matters will not be shared unless permission is given.

This can help people explore possible solutions without feeling that every thought or proposal will immediately be passed to the other side.

When might hybrid mediation be suitable?

Hybrid mediation can be suitable where there are issues that may be too complex or difficult for traditional mediation, but where both people still want to try to avoid court proceedings.

It may be helpful in cases involving:

Complex financial arrangements
Business assets
Property disputes
Pensions
Spousal maintenance
Child arrangements
Schooling disputes
Relocation issues
High conflict separation
Communication difficulties
Power imbalance concerns
Cases where solicitors need to be involved in the discussions

Hybrid mediation can also be useful where one or both people do not feel able to sit in the same room for the whole process. In those circumstances, separate rooms or shuttle arrangements may be considered.

What are the benefits of hybrid mediation?

Hybrid mediation can offer a practical alternative to court where the right safeguards are in place.

The potential benefits include:

A more flexible process

A private and confidential setting

The ability to involve solicitors directly

A greater chance of resolving complex issues

Reduced pressure compared with direct negotiations

A more constructive approach than court proceedings

Potentially quicker progress than litigation

More control over the outcome

A process that can be tailored to your family

Where an agreement is reached, solicitors can help formalise the terms, for example through a draft consent order in financial matters or a written parenting agreement where appropriate.

Is hybrid mediation suitable for every case?

Hybrid mediation is not suitable for every family.

Before the process begins, there should be careful consideration of suitability, including safeguarding, domestic abuse, capacity to negotiate, financial disclosure and whether both people are able to participate freely.

If hybrid mediation is not suitable, there may be other options available, including solicitor negotiation, collaborative law, private FDR, arbitration or court proceedings.

Mediation is generally private and confidential. In hybrid mediation, the mediator may also be able to hold confidences, meaning certain information shared privately is not passed on unless permission is given.

It can be suitable in some higher conflict cases, especially where separate rooms, solicitor support and a structured process may help. Suitability must be assessed carefully.

It can be quicker than court proceedings in many cases, although this depends on the issues, the parties and whether enough information is available to make progress.
