Emergency Protection Order

An Emergency Protection Order (EPO) is a legal measure that allows the court to act swiftly to ensure the safety of a child who is believed to be in immediate danger of significant harm. Granted at the request of the local authority or, in some cases, an authorized person, an EPO provides temporary protection, giving the authority the power to remove the child from a potentially harmful situation or to prevent their removal from a safe place.

An EPO can last up to seven days, during which time the local authority may seek further legal orders, such as a care or supervision order, to ensure the long-term safety and welfare of the child.

FAQs

An EPO is issued when a child is believed to be in immediate danger of significant harm, requiring urgent intervention to ensure their safety. This might include situations of abuse, neglect, or other serious threats to the child’s well-being.

An EPO can last up to seven days. Before it expires, the local authority must decide whether to return the child to their usual place of residence or apply for a further court order, such as a care or supervision order, to continue to protect the child.

Yes, you have the right to challenge an EPO. It is crucial to seek legal advice as soon as possible if you wish to do so. Southgate Solicitors can help you understand your options and represent you in any legal proceedings.

Parents retain certain rights under an EPO, including the right to be informed about where their child is (unless disclosing this information would place the child at risk) and potentially to have contact with the child. The specifics of these rights can vary, so legal advice is essential.

Our team can provide immediate legal advice and representation. We can help you understand the implications of the EPO, represent you in court, and work towards securing the best possible outcome for your family.

If you believe an EPO has been wrongfully issued against your child, contact us immediately. Timely legal intervention is crucial to challenge the order and safeguard your child’s welfare.

Preventing an EPO generally requires addressing the concerns of the local authority before they escalate to the point of requiring urgent intervention. If you are facing potential EPO proceedings, engaging with legal support as early as possible is essential.
