Child maintenance

Child maintenance is a financial support payment made by the non-resident parent to the parent who primarily cares for the child. It covers the child’s living expenses and is calculated based on the income of the non-resident parent, how often the child stays with them, and other relevant factors.

Our team at southgate solicitors is dedicated in ensuring that children’s financial needs are met following the separation of their parents. Understanding the importance of child maintenance, we provide comprehensive legal advice and support to parents navigating the complexities of securing financial support for their children.

FAQs

Child maintenance refers to the financial support provided by one parent to the other for the benefit of their child or children following separation or divorce. It is intended to cover the child’s everyday living expenses, such as food, clothing, housing, education, and healthcare.

The amount is typically calculated based on the non-resident parent’s gross taxable income, the number of children they support, and the amount of time the child spends with them. The UK government offers an online calculator to estimate payments.

Yes, it’s possible and often preferable for parents to agree on maintenance payments directly. This approach allows for flexibility and can avoid the fees associated with CMS. However, such agreements aren’t legally binding unless made into a consent order by the court.

If parents cannot agree, either can apply to the CMS, which will assess and enforce a maintenance amount. The CMS aims to reduce conflict and ensure children receive the support they need.

In certain cases, such as if the non-resident parent lives abroad, or if the non-resident parent’s income is significantly high, you might seek a court order for child maintenance, potentially including a “top-up” beyond the CMS maximum calculation.
