A mother has been ordered to return her five children to their father in the United States after a UK court ruled that she had taken them to England without his consent.
This case, brought under the Hague Convention on International Child Abduction, involved a couple who had spent their married life in the US. The mother (M) removed the children in June 2023 following the couple’s separation. The father (F) initiated legal proceedings in January 2024, asserting that the removal was wrongful.
The couple, originally from the UK and Ireland, had endured a volatile 16-year relationship. In prior disputes, M had taken the children to England without F’s consent but had been persuaded to return to the US. The couple’s separation in March 2023 marked the definitive end of their marriage.
M argued that F had consented to her departure, citing discussions about relocating and F’s assistance in obtaining a passport for their youngest child, born in March 2023. She also claimed F had offered to purchase a caravan for her in England, further indicating his consent.
Sir Andrew McFarlane, President of the Family Division, rejected M’s claims, highlighting inconsistencies in her evidence. He pointed to F’s immediate actions following her departure, including contacting police and seeking court orders for the children’s return, as evidence of non-consent.
“The mother asserts that the father consented,” Sir Andrew said. “While there is some merit in her evidence, it does not satisfy me that, at the time of departure, the father was consenting to the removal.”
The court relied on the Hague Convention, which mandates the return of children taken across borders without proper consent to their country of habitual residence. This principle ensures custody disputes are resolved within the appropriate jurisdiction and protects parental rights.
Sir Andrew underscored the significance of adhering to the Hague Convention in cases of international child abduction. He stressed that its principles are crucial for safeguarding family stability and avoiding prolonged disputes.
