More Families to Be Eligible for Financial Help with Court Fees

The Government has increased the income threshold for the ‘Help with Fees’ scheme to enable more families to get help with court costs. The scheme improves access to justice by providing financial assistance to those on low income and with little to no savings.

Increased Eligibility

The income and capital eligibility thresholds are being raised significantly, potentially supporting thousands more people. The scheme is also being simplified, making it easier for people to use, including allowing legal representatives to complete applications.

Examples of New Thresholds

  • For a couple with two children under 14, the monthly income threshold increases from £1,875 to £2,980.
  • For a single person with no children, the threshold increases from £1,170 to £1,420.

Additional financial support will be provided for parents with children aged 14 or over due to the higher costs associated with older children.

Improved Access

The changes include:

  • More flexibility for individuals with savings and investments by increasing the minimum capital threshold.
  • Easier qualification for the self-employed and those with variable incomes.
  • Ensuring those on higher incomes contribute more towards their fees.
  • Raising the age cap from 61 to the state pension age of 66.
