The Case Details
The divorce case involved a couple married for ten years, with the husband aged 64 and the wife aged 48. Both parties had children from previous relationships. A notable disparity existed in their contributions to the marriage: the husband brought approximately £15 million in assets, while the wife contributed £500,000.
Mental Health Considerations
The wife experienced significant mental health issues, including suicide attempts. At one stage, her condition prevented her from continuing with the divorce proceedings, leading to a request for an adjournment. The court received two psychiatric reports evaluating her health.
Financial Requests and Court Decision
The wife requested a lump sum of £3.9 million, including £1.25 million for housing and £2.6 million for lifetime maintenance of £100,000 per year. The husband, however, argued for a total settlement of £2.5 million.
Given the medical evidence, the court decided that the wife’s needs should be “assessed generously.” She was awarded £3,277,300, comprising £1 million for housing and £2.1 million for capitalised maintenance at £100,000 per year. Judge Booth permitted the husband to pay in three instalments over 12 months, with interest set at 3.75%.
