Backlog for Lasting Power of Attorney applications beginning to ease

The backlog for processing Lasting Power of Attorney (LPA) applications is starting to ease, according to recent figures provided by a government minister.

Improving Processing Times

Concerns have been raised that delays by the Office of the Public Guardian (OPG) in processing LPAs have hindered families’ ability to act on behalf of vulnerable relatives. The backlog, which accumulated during the Covid pandemic, is now showing signs of improvement.

Justice Minister Mike Freer stated in Parliament that the time taken to register and process an LPA peaked at just over 20 weeks last October. By February 2023, this figure had fallen to less than 18 weeks, with expectations for further reductions by the end of the year.

Measures Taken to Address the Backlog

Although Mr Freer did not specify when the OPG’s target of eight weeks would be achieved, he mentioned several measures to expedite the process. These include implementing shift patterns for OPG staff, hiring additional staff, and improving process efficiencies.

Understanding Lasting Powers of Attorney

An LPA is a legal document that allows you to appoint someone to make decisions on your behalf if you become unable to do so. There are two types of LPAs:

  • Property and Financial Affairs LPA: This authorises someone to manage your financial matters, such as paying bills and handling bank accounts.
  • Health and Welfare LPA: This grants an attorney authority over healthcare decisions and the type of treatment you receive.

Importance of LPAs

Creating an LPA is a proactive step to ensure your affairs are managed according to your wishes, providing peace of mind for you and your loved ones. Despite the delays, it’s crucial to establish an LPA while you are fit and healthy to avoid future complications.
