Government Initiative
The government has allocated an additional £6 million to support up to 2,000 individuals applying for Special Guardianship Orders (SGOs). This form of care places a child in need with extended family, friends, or foster parents until they reach 18 years of age.
Legal Aid Funding
These cases are often intricate, emotionally charged, and challenging for families striving to secure the best outcomes for vulnerable children. With the new funding, applicants in private law hearings can now access legal aid for advice and representation, alleviating one significant burden for families.
Support for All Parties
The funding will also cover free legal representation for parents opposing SGOs in private law proceedings, ensuring they receive the necessary support and advice. This comprehensive approach aims to provide balanced support for all parties involved.

Justice Minister Lord Bellamy stated, “Providing a stable, loving home for a vulnerable child in need is an utterly selfless act and it is right we provide families with the vital support they need – particularly in the most complex and emotive of cases.”
Previous Legal Aid Limitations
Previously, legal aid was only available for SGO cases initiated by local authorities aiming to remove a child from their birth parents. The extension to include private law cases reflects a broader investment in civil and criminal legal aid.
Standardised Testing
Additionally, the government is standardising the means and merit testing requirements for birth parents in proceedings where a local authority seeks to place a child for adoption.
