A Non-Molestation Order is a legal injunction issued by a court to protect individuals from harassment, violence, or threats of violence by another person. It aims to prevent further harm and provide immediate relief to victims of domestic abuse or harassment. 

Any individual who is experiencing harassment, violence, or threats of violence from another person, such as a partner, spouse, family member, or acquaintance, can apply for a Non-Molestation Order. 

To apply for a Non-Molestation Order, the individual must submit a Form FL401 to the family court, along with evidence supporting the need for protection. In urgent cases, emergency orders can be obtained without the respondent’s knowledge. 

A Non-Molestation Order prohibits the respondent from molesting, harassing, intimidating, or threatening the applicant or any relevant child. It can also prevent the respondent from contacting the applicant directly or indirectly. 

Non-Molestation Orders are typically granted for a specified period, often up to one year. However, they can be extended if necessary to ensure ongoing protection for the applicant and any relevant children. 

Breach of a Non-Molestation Order is a criminal offense punishable by imprisonment, fines, or both. Victims can report breaches to the police, who have powers to arrest and prosecute offenders. 

Yes, Non-Molestation Orders can be used to protect relevant children who may also be at risk of harm from the respondent’s behavior. The orders can include provisions to prevent the respondent from contacting or approaching the children. 

Non-Molestation Orders play a crucial role in safeguarding individuals and families from abusive or threatening behavior. They offer legal protection, allowing victims to feel safe and secure in their homes and daily lives, and provide a means of recourse if the orders are breached.
