Mediation Information & Assessment Meeting (MIAM)

A Mediation Information and Assessment Meeting (MIAM) is a compulsory initial meeting required by the Family Mediation Council (FMC) before individuals can apply to the court for certain family law matters. The purpose of the MIAM is to provide information about mediation as an alternative method of resolving disputes and to assess whether mediation is suitable for the parties involved.

In most family law disputes, individuals need to attend a MIAM before applying to the court for orders like Child Arrangements Orders or Financial Remedy Orders. 

At a MIAM, the mediator explains mediation, its benefits, costs, and process. They also assess whether mediation is suitable, considering factors like the nature of the dispute and parties’ willingness to participate. 

Yes, in most cases involving UK family law disputes, attendance at a MIAM is compulsory. There are exemptions, like cases of domestic abuse or where mediation isn’t feasible. 

If mediation isn’t suitable or parties can’t reach an agreement, they can proceed to court for resolution. 

Yes, information shared during the MIAM is confidential. The mediator won’t disclose it unless safety concerns arise, such as domestic abuse. 

No, mediation participation is voluntary. Parties can pursue other options if mediation isn’t suitable or if they don’t reach an agreement. 

A MIAM typically lasts 45 minutes to an hour, though duration varies based on case complexity and discussion topics.
